Accommodation Requested and Accommodation Open
1. Mutual of Omaha will initiate our ADA process whenever an employee needs accommodation for his/her own health condition and:
- Is ineligible for FMLA and/or state leave due to hours worked
- Is ineligible for FMLA and/or state leave due to length of employment
- Has exhausted his or her FMLA entitlement
Remember: Mutual of Omaha will assess and deny FMLA before initiating the ADA process.
2. Paperwork Sent and Paperwork Returned
Mutual of Omaha will send the following documentation:
- An ADA-specific accommodation “request letter”
- A blank ADA medical inquiry form
- Allows for deeper inquiry than an FMLA medical certification form
- Copy sent directly to the health care provider if authorized
- Employee has 15 days to return paperwork
3. Decision Rendered
Once Mutual of Omaha receives all forms and documentation:
- Mutual of Omaha shares the completed ADA form with the Benefits Administrator
- Mutual of Omaha seeks the Benefits Administrator's decision on whether your team can reasonably accommodate the ADA request
In corroboration with Mutual of Omaha, the Benefits Administrator will:
- Engage in ADA “interactive process” with employee
- Benefits Administrator may contact you (Manager) for input
- Benefits Administrator makes accommodation decision
Unlike FMLA, an ADA accommodation request could be denied if accommodation would cause “undue hardship” for employer.
Remember: Mutual of Omaha will send the ADA decision letter
